Voting Rules and Regulations

Voters must be a member of the driver fan clubs located on www.RoushFenway.com.  Contest is run by Roush Fenway Racing and is not affiliated with any other organization.

Voting begins Friday, January 15, 2009 and ends Friday, January 22, 2009 at 11:59 pm ET. Voters may vote as many times per day as they’d like and all votes must be submitted online between Friday, January 15, 2009 and ends Friday, January 22, 2009 at 11:59 pm ET.  NO EMAIL OR HAND-WRITTEN ENTRIES WILL BE ACCEPTED.

ABOUT THE CONTEST: Throughout the year, a Roush Fenway Racing Fan of the Week winner will be selected by a group of judges selected by Roush Fenway Racing.  Those weekly winners will be posted after the end of the 2009 NASCAR season and fan club members will be the ones to determine the 2009 Roush Fenway Racing Fan of the Year through an online voting process that will run from Friday, January 15, 2009 and ends Friday, January 22, 2009 at 11:59 pm ET.  Fan Club member votes will be the only determining factor in the selection of the winner.

HOW TO VOTE: Visit www.RoushFenway.com to view the 2009 Roush Fenway Racing Fan of the Year finalists. Then follow the on-line instructions to vote for your favorite fan. Voters may vote as many times per day as they’d like and all votes must be submitted online between Friday, January 15, 2009 and ends Friday, January 22, 2009 at 11:59 pm ET.  NO EMAIL OR HAND-WRITTEN ENTRIES WILL BE ACCEPTED.

RELEASES AND GENERAL CONDITIONS: By voting in the Roush Fenway Racing Fan of the Year contest (Contest), you agree: (a) to be bound by these voting guidelines and the decisions of Roush Fenway Racing (Sponsor), which shall be final and binding, and (b) that the Sponsor, its parent companies, their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with the voting portion of the Contest, whether caused by www.RoushFenway.com, www.RoushFenwayFanSite.com, www.RoushRacingForums.com and all other associated websites’ (Website) users, tampering, hacking, or any of the equipment or programming associated with or utilized in the voting portion of the Contest; (2) any error, omission, interruption, deletion, defect, delay in operation or unauthorized access to the Website or in any materials associated with the voting portion of the Contest; (3) any injury, damage, or loss to participant's or any other person's computer related to or resulting from participating in the voting portion of the Contest or downloading materials from, or otherwise using, the Website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the voting portion of the Contest; (6) misdirected, late, lost, undelivered, or unprocessed votes; (7) any condition caused by events beyond the control of the Sponsor or its agents which may cause the voting portion of the Contest to be disrupted or corrupted; or (8) any loss, injury or damage of any kind caused by participation in the voting portion of the Contest. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of the voting portion of this Contest should encounter fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies that corrupt or affect the administration, security, fairness or proper play or conduct of the voting portion of the Contest.

If for any reason, the winner of the contest is deemed unsuitable, the Sponsor reserves the right to award the distinction to the runner-up.  Because the Fan of the Year is an “official representative” of the Sponsor, the winner MUST display appropriate behaviors when it comes to any and all activities associated with their Fan of the Year duties.  The Sponsor may, at any time, discontinue their relationship with the Fan of the Year winner if it sees or hears of any personal behaviors that could misrepresent the Sponsor or damage the Sponsor’s image to the public in any way.  In this case, the Sponsor reserves the right to select the new Fan of the Year winner.

If the winner is younger than the age of 18, the parent or guardian will assume the roles and responsibilities of the winner.  The only representation of the winner if s/he is under the age of 18 will be the original picture that was submitted online.  The prize package will have to be altered to conform to United States government regulations, official NASCAR regulations and the Sponsor’s obligation to adhere to these standards and practices.

PRIZE DETAILS: The 2009 Roush Fenway Racing Fan of the Year will be Roush Fenway Racing’s VIP guest at the 2010 Coca-Cola 600.  Schedule and details will be provided at a later date.  Travel accommodations, including airfare and hotel, for winner and one (1) guest will be provided. The winner will also receive apparel and merchandise designating them the 2009 Roush Fenway Racing Fan of the Year. S/he will be recognized in a display at the Roush Fenway Racing museum in Concord, North Carolina and will be featured on RoushFenway.com in a designated 2009 Roush Fenway Racing Fan of the Year area. The 2009 Roush Fenway Racing Fan of the Year will serve as the “official spokesperson” of the Roush Fenway Racing Online Fan Clubs and will be used in various press releases and online multimedia materials throughout the year.  Roush Fenway Racing reserves the right to change the contents of this prize package at any time, depending upon asset availability.

If the above-mentioned race is cancelled or postponed for any reason while the winner is in attendance, the trip will NOT be rescheduled for another race. If the race is cancelled or postponed for any reason in advance, the trip will be reissued for another race or race date selected by Roush Fenway Racing. Actual prize and trip value may vary based on point of departure, fare fluctuations and hotel availability. The 2009 Roush Fenway Racing Fan of the Year is entitled to bring one (1) guest. Winner and guest must travel together on the same itinerary and must be available to travel on dates specified by Roush Fenway Racing or prize package may be forfeited. Travel and hotel accommodation restrictions may apply. Federal, state and local taxes and all other expenses, including daily meals, souvenirs and other merchandise, not specified herein are the sole responsibility of the individual winner.

No substitutions or transfers of prize, except by Roush Fenway Racing (due to prize or portion of prize availability, for a prize of equal or greater value. By entering, entrants agree: 1) to be bound by these Official Rules and that the decisions of the judges will be binding and final in all respects; and 2) that Roush Fenway Racing and its designees shall have the right and permission to use winner’s name and photograph for advertising, promotional and/or any other purpose in any media without additional compensation unless prohibited by law. Grand prize winner will be required to execute and return all pertaining releases and documentations (where legal) within 10 days of issuance of prize notification.

Winner’s traveling companion must also execute and return all pertaining releases and documentations (where legal) prior to issuance of travel documents. Non compliance with any of the foregoing or return of prize notification/documentation as non-deliverable may result in disqualification and an alternate winner being selected. If identity of winner is disputed based on the email address submitted, prize will be awarded to the person identified as the authorized account holder of the email address at the time the entry is submitted as determined by Roush Fenway Racing in its sole discretion. Proof of emailing does not constitute proof of delivery.

By entering, entrants agree that all involved Contest parties and their respective parent, subsidiary and affiliated companies and their respective shareholders, officers, directors, employees, representatives, sponsors, partners and agents are not liable and shall be held harmless by entrant for any claim, action, liability, loss, injury and/or damage to entrant and/or any other person and/or entity, including, without limitation, personal injury and/or death to entrant and/or any other person, and/or damage to personal and/or real property, due in whole or in part, directly or indirectly, by reason of acceptance, possession, use and/or misuse of prize and any travel or activity related thereto and/or participation in this promotion.

WHO WON: The 2009 Roush Fenway Racing Fan of the Year winner will be posted online on or about Monday, January 25, 2009. The winner can be found by visiting www.RoushFenway.com; or for the name of the winner, send a self-addressed, stamped envelope to: Roush Fenway Racing Fan of the Year, 4600 Roush Place, Concord, NC 28027.
